Lord Kames was trying to change how people understood law as legal reform. Rather than treating law as a collection of rules to memorize, he argued that laws should be studied historically by asking how and why legal customs developed as societies changed. In Historical Law-Tracts, he compares Roman, English, and Scottish law and discusses subjects such as property, contracts, evidence, inheritance, courts, and debt. This work is a part of the Scottish Enlightenment. Kames was a prominent Scottish judge and intellectual associated with the same remarkable period that produced thinkers such as David Hume and Adam Smith.
